本书从国家建设与公民保护角度出发，探讨了美国黑人民权背后的政治体制变迁。在南北战争以前，联邦政府无权干预各州公民权利保护，只能任由南方各州维持奴隶制度。内战结束以后，联邦政府借助最高法院的司法审查，不断拓展国家治理范围，最终成为美国公民权利的首要“保护者”。第二次世界大战结束后，联邦政府更是通过提供财政补贴，获得了诸多约束各州政府的隐性手段。在这种背景下，美国三大权力分支才得以开启反种族主义行动，走上了公民权利平等保护之路。美国黑人“站”起来的过程说明，合理的国家政权建设，对于公民权利保护具有重大意义。
