本书以《涉外商事海事审判指导》（1-34辑）列示的最高人民法院复函案例为研究对象，以《民事诉讼法》第274条规定的五类司法审查依据为纬，以“案情简介+双方诉答+司法审查+案件评析”的分析框架为经，逐一研析最高人民法院民四庭所遴选刊出的典型案例，力图完整、真实和类型化地向读者展示案涉相关中级人民法院、高级人民法院和最高人民法院对我国涉外仲裁裁决进行司法审查的实践全貌。本书不追求学理上的统一性、体系性和规范化，而是秉持“让案例说话”的原则，通过图表凸显案件本身的情节、浓缩双方当事人的诉答、提炼司法机关的审查意见，确保“全息”呈现案件本身的信息，并逐案对各关键要点进行学理“点击”。
This book takes the Supreme People's Court's reply cases listed in the Guidance for Foreign-Related Commercial and Maritime Adjudication (Series 1-34) as the research object, takes the five types of judicial review bases stipulated in Article 274 of the Civil Procedure Law as the basis, and takes the analytical framework of "brief introduction of the case + answers of both parties + judicial review + case analysis" as the analysis framework, and analyzes the typical cases selected and published by the Fourth Civil Division of the Supreme People's Court one by one, and strives to show readers the relevant intermediate people's courts and cases involved in the case in a complete, truthful and typed manner. A comprehensive picture of the practice of judicial review of foreign-related arbitral awards in China by the Higher People's Court and the Supreme People's Court.
