刑事诉讼是一种由一系列诉讼行为连接起来的动态锁链，这些行为按照一定的顺序进行，并指向实施刑法这一固定的目标。不过，刑事诉讼法并非仅仅是辅助于刑法实施的一部程序法，在很多时候，它负担着规定一个国家刑事司法制度和刑事追诉程序的重任。其内容包括职能机关的职权和分工，审判制度和审前制度（侦查制度和起诉制度）。刑事诉讼可以理解为一国刑事司法制度的动态表现，因此将刑事诉讼法称为刑事制度法或许更为合理。研究我国刑事诉讼的发展，探索刑事诉讼的本质和规律，以此预见中国刑事诉讼的趋势，可能是刑事诉讼法立法40年之后，我们应当肩负起的一个新使命。本书以此为指导，着力研究近年来中国刑事诉讼的发展和趋势。
Criminal proceedings are a dynamic chain linked by a series of procedural acts that are carried out in a certain sequence and point to the fixed goal of enforcing the criminal law. However, the Code of Criminal Procedure is not merely a procedural law that complements the implementation of criminal law, but in many cases it is charged with the task of defining a country's criminal justice system and criminal prosecution procedures. Its contents include the functions and division of labor of functional organs, the trial system and the pre-trial system (investigation system and prosecution system). Criminal procedure can be understood as a dynamic expression of a country's criminal justice system, so it may be more reasonable to refer to the criminal procedure law as the law of the criminal system. Studying the development of criminal procedure in our country and exploring the nature and law of criminal procedure in order to foresee the trend of criminal procedure in China may be a new mission that we should shoulder 40 years after the enactment of the Criminal Procedure Law.
