Analysis on EU’s Submissions on Compliance Mechanism of Paris Agreement

摘要：遵约机制是那些应对共同关心的环境事项的多边条约构建的一项重要机制，旨在为缔约方之间建立互信、防止免费搭车和共同遵守条约规定。遵约机制的谈判是《巴黎协定》后续实施细则谈判的一项重要议题。美国宣布退出《巴黎协定》后，对于《巴黎协定》后续实施规则的各项议题的谈判，欧盟具有不可替代的重要作用，也对相关议题能否如期完成谈判任务发挥着重要的领导作用。本文选取《巴黎协定》遵约机制为视角，以文本分析为主要的方法，分析遵约机制实施规则谈判过程中的欧盟提案，分析谈判中欧盟的主要关切和问题，探讨《巴黎协定》遵约机制的前景，指出欧盟若需要在遵约机制的谈判中发挥领导作用，还需要就共同而有区别的责任原则等议题与发展中国家达成一定的妥协。

Abstract：Compliance mechanism is one of key mechanisms to facilitate the Parties to comply with the obligations and provisions of Multilateral Environmental Agreements，with the function of confidence building among parties，prevention of free-riding and facilitating the compliance of the obligation.The negotiation of compliance mechanism of Paris Agreement is one of the major item under APA.Since the declaration of withdrawing the Paris Agreement by USA in 2017，EU will definitely play the unique role during the further negotiations of implementation issues under Paris Agreement，and even a leadership role in facilitating the finish of the negotiating items.This paper，based on the negations of the modalities and procedures of the compliance mechanism under Article 15 of Paris Agreement，analyzes EU’s submissions and main concerns on the compliance mechanism negotiation，focusing on the merits and demerits EU’s idea or concerns on the design and operation of the compliance mechanism and ending with the suggestion that EU needs to propose and polish more bridging advice to compromise the different concerns from the diversified developing parties and developed parties in order to play the leading role and help to effective implementation of Paris Agreement in the future.
