宪法的精神旨归和终极目的在于保障人权。宪法基本权利条款立法具体化，使得宪法基本权利具化为普通法律权利，宪法基本权利亦由此衍生为法律权利群系，宪法基本权利之保障也进一步落实为具体法律保障。因此，基本权利立法是“公民权利保障法治化”的拱顶石，能够让每一个人在生活中“将权利带回家”，使得宪法真正成为人民的生活之法。本书从本体、关联、实践、成就、价值、方法等角度对基本权利立法的基础理论、影响主体、实践逻辑、历史性成就和完善方略进行了系统研究，力图建构起一个基本权利立法的理论分析框架。
