国际条约在中国法律体系中的地位问题备受学术关注，也长期困扰实践。其根源在于中国宪法对国际条约与国内法关系的“失声”。本书旨在透过基于一手资料的实证研究，把握国际条约与中国国内法关系的现状，发掘其中的问题，为制度设计提供依据。本书特色鲜明：一是从立法、执法和司法角度全面考察国际条约在中国法律体系中的实际地位；二是梳理世界193个国家的宪法如何规定国际条约与国内法的关系，以资参照；三是从宪法、立法、司法层面体系化地提出完善中国制度的具体建议。
The status of international treaties in China's legal system has attracted much academic attention and has long been a problem in practice. The root cause lies in the "silence" of the Chinese constitution on the relationship between international treaties and domestic law. Through empirical research based on first-hand information, this book aims to grasp the current situation of the relationship between international treaties and China's domestic law, explore the problems therein, and provide a basis for institutional design.
