本书是“后《慈善法》时代”第一本对我国慈善信托法进行深入系统研究的著作。本书的主要目的是尝试构建中国特色的慈善信托法解释论，在现行法律规范和实践经验的基础上展开中国慈善信托法的基本分析框架，在具体规则的分析中呈现慈善信托法的理念和制度价值。

本书主要在四个理论维度上展开。一是慈善法中的慈善信托；二是信托法中的慈善信托；三是实务操作背景下的慈善信托法规则和原理；四是比较法背录下的中国慈善信托法。我国慈善信托制度当然需要参考英美乃至日本的合理制度及其理论内核，但如何在我国的法律框架内对慈善信托法的原理和制度进行合乎逻辑的解释，继而催生中国慈善信托法的自洽话语体系，方为本书的核心关切。

This book is the first book in the "post-Charity Law" era to conduct in-depth and systematic research on China's charitable trust law. The main purpose of this book is to try to construct an explanatory theory of the Charitable Trust Law with Chinese characteristics, to develop the basic analytical framework of the Charitable Trust Law in China on the basis of the current legal norms and practical experience, and to present the concept and institutional value of the Charitable Trust Law in the analysis of specific rules. This book mainly develops in four theoretical dimensions. First, charitable trusts in the Charity Law; the second is charitable trusts in the Trust Law; Third, the rules and principles of the Charitable Trust Law in the context of practical operation; The fourth is China's charitable trust law under the comparative law.
